Terms and Conditions

Introduction

We request that all prospective customers read in full the following Terms and Conditions in order to fully understand the process of undergoing a project in conjunction with Welding Kingdom Ltd. The following text is designed to be informative and fully disclose every aspect of the job.

Definition:

The “Company” means Welding Kingdom Ltd, Registered office 21 Deerswood Avenue, Hatfield, AL10 8RX, United Kingdom.

The “Customer” means any person, company or third party as detailed.
The “Goods” means any goods or services.
The “Order” means a purchase order, either verbal or written, given by the Customer to the Company to agree for the Goods under these Terms & Conditions of sale.
Please note that all work undertaken by Welding Kingdom Ltd is subject to the following Terms and Conditions:

Building Regulations & Compliance: Welding Kingdom Ltd is a company which fulfills the client’s order and will use its best endeavours to ensure the Order are manufactured to comply fully with current UK building regulations. However, it is the Customer’s responsibility to check the suitability of the project with their building inspector prior to placing any order with our company. The Company accepts no responsibility whatsoever for third party designs.

Pre-survey: In order for the Company to provide a pre-survey quotation, the Customer must first provide CAD drawings and or plans together with all relevant measurements and a detailed specification of the works required. If the Customer accepts the Company’s pre-survey quotation, and on the condition that all necessary measurements can be taken, a free site survey is offered to Customers who proceed to Order of goods from the Company. Should the Order be cancelled or fail to be placed within 4 weeks of the date of the survey for whatever reason then the Customer will become liable for the full cost of the survey at £250 + VAT plus. Travel will be charged at the rate of £0.50 per mile from the Company’s offices to site and back plus accommodation if required. All survey costs will be invoiced to the Customer and this invoice will be due for payment

Drawing & Measurements: All drawings supplied by the Company are the copyright of Welding Kingdom Ltd and cannot be reproduced or transmitted in any format whatsoever without prior Notice from the Company. All measurements shown on pre-survey drawings are for quotation purposes only and final dimensions will only be confirmed after receipt of Order. All changes that the buyer wants to make to the drawing after confirmation will be charged. Where measurements are supplied by the Customer, the Company will not be responsible for any discrepancies. A machining tolerance of + / – 5% is allowed.

Quotations: The Company’s quotations (or work estimate) are valid for 30 days. A quotation does not constitute an offer to contract and the Company reserves the right to withdraw a quotation at any time. Where quotations are based on information provided by the Customer, such quotations are subject to the accuracy of that information supplied. Presurvey quotations may be revised following a site survey.
Any items which are not on the quotation or not discussed in precontract minutes will be deemed extras and priced for accordingly.

Terms of the Payment: Until final payment has been received, all materials & components remain the property of Welding Kingdom Ltd. Orders invoiced to a business will be required to pay a 60% deposit when ordering, 30% before installation and 10% upon completion. Deposits are used to fund the acquisition and manufacture of components for installations.
We accept payment by bank transfer.
Final balance payments should be made on completion of the installation.
Welding Kingdom Ltd will not accept an order until we have received a full deposit as detailed in the Payment section of these Terms & Conditions.

Delivery: The Company will use its best endeavours to deliver the Goods on time. However, delivery dates, where specified by the Company, are best estimates only and are of no contractual significance. In the event of any delay, the Company will contact the Customer and agree an alternative delivery date. In the event of any delay the Company will not accept cancellation of the Order nor pay any penalty to the Customer or any other third parties. Should the Customer be unable to accept delivery of the Goods on the agreed date for whatever reason, any outstanding balance must be paid into the Company’s bank account in cleared funds on or by the agreed delivery date. Thereafter, the Company will store the Goods free of charge for a period of 2 weeks, after which the Company reserves the right to make a charge for storage and insurance of the goods at the rate of £100 per week or part thereof. No goods will be allowed out of storage until all storage charges have been paid by cleared funds into the Company’s bank account.

Delivery Restrictions: Many small streets have weight, height and / or delivery time restrictions that may require the dispatch of a special delivery vehicle. It is the Customer’s responsibility to inform the Company prior to delivery if any such restrictions apply. The Customer will be held responsible for all delivery costs if the delivery address is inaccessible due to restrictions that have not been made known to the Company. The Customer hereby agrees to pay the Company for any penalties that are incurred by a carrier due to: street blockage by delivery vehicle; unloading taking longer than allowed by authorities; parking violations of any kind that occur while the vehicle is unloading at the Customers location. Where site conditions dictate, it is the Customers responsibility to provide sufficient manual labour to assist in off loading the goods.

Installation: The Company accepts no liability for any issues relating to the installation of the Goods. Under no circumstances will the Company be responsible for any remedial building, plastering or decorating works and unless otherwise stated. Dates given for installations may be subject to change at any time, due to a number of logistical factors. Whilst we always endeavour to stick as closely as possible to our proposed start dates, occasionally it is unavoidable that work must be delayed. The Company will not be held responsible for any losses made during this period and will not be liable for any inconvenience caused.
In the rare instance that any materials are out of stock, we will contact you directly and immediately to discuss options.
On rare occasions, due to events such as flooding, extreme weather, accidents, breakdowns, interruptions of supply, illness, theft, malicious damage, etc. we may not be able to carry out work as planned. In such circumstances, we will aim to begin work as soon as it is physically possible, however we will not be held liable for any delay caused.
Please note if we carry out works according to your instruction, design details, or measurements and we subsequently find that your instructions are such that work cannot be installed or adaptions need to be made then extra charges will be incurred at our discretion. Part (1) additional days required. Additional site days required are charged at £650.00 per day for a two-man team. Part (2) Additional workshop days will be charged at £450.00 a day per fabricator. Materials are not included and will be charged extra.
If you book work with us and confirm the work site will be ready for us to work on or install our goods and we arrive and work is not possible. It will be at our discretion to charge a miss-appointment free of £350.00 + VAT per team that we send.
